Q: What rights do employee's have with regard to smoking, and does the employer have a legal obligation to provide a smoking area off the premisis?

On July 1st 2007, England introduced a new law to make virtually all enclosed public places and workplaces in England smokefree.

You can find more information on your obligations as an employer on the Smokefree England website, here:

www.smokefreeengland.co.uk

It states that 'there is no requirement to provide smoking shelters. It is common for health-focused employers not to spend money creating places for smokers to congregate.'
